These Terms form a binding legal agreement between you and Aquarius Financial L.L.C., a West Virginia limited liability company (“Aquarius,” “we,” “us,” or “our”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
The Service
Aquarius Financial L.L.C. provides AI-powered analytical tools for U.S. equities and digital assets, including technical analysis, sector intelligence, real-time alerts, and Ganymede — our proprietary research agent. The Service is an informational and analytical platform. It does not execute trades, custody assets, or act as a broker-dealer or investment adviser.
We may add, modify, or remove features at any time without prior notice. We will use reasonable efforts to communicate material changes that affect paid functionality.
Eligibility & Accounts
You must be at least 18 years old and capable of entering a binding contract to use the Service. You agree to provide accurate, current, and complete information when registering, and to keep your credentials confidential.
- You are responsible for all activity that occurs under your account.
- You will notify us promptly of any unauthorized access or security breach.
- One person or entity may not maintain multiple accounts without our written consent.
- We may suspend or terminate accounts that violate these Terms or applicable law.
Not Financial Advice
All content provided through the Service — including signals, indicators, sector analysis, AI-generated commentary from Ganymede, and any written materials — is for informational and educational purposes only. Nothing on the platform constitutes investment advice, a recommendation, an offer to buy or sell any security, or a solicitation of any kind.
Aquarius Financial L.L.C. is not a registered investment adviser, broker-dealer, or financial planner. You should consult a licensed professional before making any investment decision and you alone are responsible for your trades.
Trading Risk Disclosure
Trading equities and digital assets involves substantial risk of loss and is not suitable for every investor. Past performance is never a guarantee of future results.
You acknowledge that:
- Markets are volatile, and prices can move sharply against your position.
- Cryptocurrency markets are particularly susceptible to extreme volatility, illiquidity, and regulatory change.
- Technical indicators describe historical and current price behavior — they do not predict the future.
- Backtested or hypothetical performance figures have inherent limitations and may not reflect live conditions.
- You may lose all of your invested capital. Do not trade with funds you cannot afford to lose.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable securities, commodities, or anti-money-laundering laws.
- Scrape, mirror, reverse engineer, decompile, or otherwise extract source data or models from the Service.
- Use automated systems, bots, or crawlers to access the Service beyond rate limits we expose publicly.
- Resell, sublicense, or redistribute Service output without our written authorization.
- Interfere with, disrupt, or attempt to gain unauthorized access to our systems, infrastructure, or other users' accounts.
- Use the Service to defame, harass, or harm any person or entity.
AI & Ganymede Output
Ganymede is an AI-powered analytical assistant. Its outputs are probabilistic, can be incomplete, and may contain errors or fabrications. You agree to independently verify any factual claim, citation, or quantitative figure before acting on it.
You retain ownership of the prompts and inputs you provide. You receive a non-exclusive license to use Ganymede outputs for your personal or internal business use. We may use de-identified, aggregated interaction data to improve the Service.
You agree not to submit confidential third-party information, material non-public information, or personally identifying information of others into Ganymede without proper authorization.
Intellectual Property
The Service, including all software, models, design, copy, charts, indicators, and the Aquarius name and logo, is owned by Aquarius Financial L.L.C. or its licensors and is protected by U.S. and international intellectual property laws.
We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Service for its intended purpose. No other rights are granted by implication or otherwise.
Market Data & Third Parties
The Service incorporates market data, news feeds, and other content from third-party providers. Such data is provided “as is” and may be delayed, inaccurate, or unavailable. Third-party providers may impose additional terms on the display, redistribution, or use of their data, and you agree to comply with those terms.
Aquarius Financial L.L.C. is not responsible for the content, accuracy, or availability of any third-party service, integration, or linked website.
Fees & Billing
Certain features of the Service may require a paid subscription. Pricing, billing cycles, and feature tiers will be presented at the point of purchase. Unless otherwise stated, fees are non-refundable.
You authorize us (and our payment processors) to charge your designated payment method on a recurring basis until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period.
Termination
You may terminate your account at any time by following the cancellation steps in your account settings or by contacting us. We may suspend or terminate your access immediately if you breach these Terms, present a security or legal risk, or if continued provision of the Service becomes commercially impracticable.
Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, Aquarius Financial L.L.C. disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability.
We do not warrant that the Service will be error-free, secure, or that any signals or analyses will be profitable.
Limitation of Liability
To the maximum extent permitted by law, in no event shall Aquarius Financial L.L.C., its affiliates, members, managers, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, trading losses, or loss of data — arising out of or related to your use of the Service.
Our aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the fees you paid to us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
Indemnification
You agree to defend, indemnify, and hold harmless Aquarius Financial L.L.C. and its affiliates, members, and managers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
Governing Law & Disputes
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-laws principles. You and Aquarius Financial L.L.C. agree to resolve any dispute exclusively in the state courts of Raleigh County, West Virginia, or the United States District Court for the Southern District of West Virginia, and consent to personal jurisdiction there.
Any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the Service or by email at least seven (7) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
